Terms & Conditions

1. Service Overview

I provide digitization and media conversion services, including but not limited to photos, slides, DVDs, and other personal media formats. All work is performed on a best-effort basis based on the condition of the original materials provided.

2. Customer Responsibility

• You own or have legal rights to the materials provided.
• You have retained or made copies of any items you consider irreplaceable prior to submission.
• You understand that original media may be fragile due to age or condition.

3. Quality & Results

• Results may vary depending on the condition of the original media.
• I do not guarantee restoration of damaged, faded, or degraded materials.
• Output quality is limited by the source material provided.

4. Handling of Materials

All items are handled with care. However:

• Minor wear or degradation may occur due to normal handling of aging media.
• I am not responsible for pre-existing damage or deterioration revealed during processing.

5. Limitation of Liability

In the unlikely event of loss or damage:

• Liability is limited to the cost of the specific service provided for the affected item(s).
• No liability is assumed for sentimental or replacement value.
• I am not liable for loss or damage resulting from events outside of my control, including but not limited to fire, flood, earthquake, theft, power outages, hardware failure, or other acts of nature or third parties.

6. Turnaround Time

Estimated completion times are provided as guidance only and may vary depending on workload and project complexity.

7. Payment

Payment terms are agreed upon prior to or at the time of service. A deposit may be required at the time of service, and the remaining balance is due upon completion of the work. Completed work and materials may be withheld until payment is received in full.

8. Personal Use Only

All converted media and digital files provided through this service are intended for personal use only. By using this service, you agree that converted materials will not be uploaded, posted, publicly shared, redistributed, sold, streamed, or otherwise used in a way that violates copyright or other ownership rights. This includes, for example, digitized music, video, or other recordings that are converted for private and family listening, viewing, backup, or archival purposes only.

9. Project Completion & Payment

Upon completion of a project, the customer will be notified that the completed project is ready for delivery or pickup. Any remaining balance is due upon completion and must be paid before digital files are released or completed deliverables are provided.

Customers are responsible for responding to completion notifications and making arrangements for payment and delivery or pickup.

10. Media Abandonment

Original media, customer-provided storage devices, and completed physical deliverables will be held for 30 days following the date of project completion notification.

Customers are responsible for arranging pickup, delivery, or return shipping within this period. If the customer does not respond or make arrangements within 30 days, the items may be considered abandoned.

After 30 days, JM Digital Services is no longer responsible for storing, returning, or safeguarding abandoned media, storage devices, or completed deliverables. Abandoned items may be securely discarded, recycled, or reused at the discretion of JM Digital Services.

11. Digital File Storage

Completed digital files provided through Google Drive will be retained for 30 days following the date of project completion notification.

Customers are responsible for downloading their files or copying them to their own storage before the 30-day period expires. After 30 days, files may be permanently deleted from JM Digital Services’ Google Drive storage and may not be recoverable.

12. Unwanted Original Media

If a client does not wish to have their original media returned, they may authorize JM Digital Services to dispose of the media on their behalf. With the client’s permission, JM Digital Services may retain selected media, storage devices, cases, or other materials that are suitable for future business use.

Materials not retained for reuse may be discarded or recycled where reasonably possible.

13. Agreement

By submitting materials for service, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
